Terms of Service

These terms govern your use of this website and the services of Momentum Media Studio (“we,” “us,” or “our”), a service business based in the Pittsburgh, Pennsylvania area. By using this site or engaging our services, you agree to them.

What we do

We set up missed-call text-back and customer messaging systems for local service businesses, along with related written content and setup work. The specifics of any engagement — scope, price, timeline, and guarantee — are stated in writing before work begins, and that written agreement controls if it differs from anything here.

SMS messaging program terms

We operate text messaging programs for our own business and set them up on behalf of client businesses. If you have opted in to receive text messages from us or from a program we operate:

  • Program description: messages respond to calls and inquiries you initiate — such as a text following a missed call — and provide answers, scheduling, and service updates you have requested or consented to receive.
  • Message frequency varies depending on your conversation and requests.
  • Message and data rates may apply, according to your mobile plan.
  • Reply STOP to cancel at any time. You will receive a final message confirming your opt-out, and nothing further.
  • Reply HELP for help, or contact us using the information at the bottom of this page.
  • Carriers are not liable for delayed or undelivered messages.
  • Consent to receive text messages is not a condition of purchasing any goods or services.

Our Privacy Policy describes how phone numbers and message content are handled. Phone numbers collected for messaging are never sold or shared with third parties for their marketing purposes.

Payment

New clients start with a free 14-day trial, beginning the day text messages go live on your line. No payment card is required to start the trial. If you choose to continue, service is billed monthly at the price stated on this site and in your written agreement, starting the day after the trial ends. Service is month to month with no contract, and you may cancel at any time. Cancellation takes effect at the end of the current billing period.

Free trial and cancellation

If you decide not to continue before your free trial ends, tell us and we will remove the system and restore your prior setup. You owe nothing. After the trial, you may cancel at any time by text or email, and we will remove the system and restore your prior setup at the end of your current billing period. Monthly fees already paid are not refunded for a partial month.

Your responsibilities

What we don’t promise

We promise the system will work as described and that we will fix it promptly when it doesn’t. We do not guarantee any particular business outcome, such as a number of recovered calls or booked jobs, because those depend on factors outside our control.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of our services is limited to the amount you paid us for the services giving rise to the claim. We are not liable for indirect or consequential damages, or for failures caused by third-party carriers, networks, or services.

Intellectual property

While your account is in good standing, the written content and answers we create for you are yours to keep, including after you cancel. The tools, templates, and methods we use to build them remain ours.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute will be resolved in the courts of Allegheny County, Pennsylvania.

Changes

If these terms change, the new version will be posted here with a new effective date. Changes do not apply retroactively to work already agreed in writing.
